NNPP chieftain sues Borno govt over demolition of shopping plaza

Must read

Hon. Attom Magira, a prominent member of the New Nigeria Peoples Party (NNPP), has taken legal action against the Borno State government following the demolition of his multi-million-naira shopping complex in Maiduguri.

The four-storey plaza, situated along Sir Kashim Ibrahim Road, opposite the State Low-Cost Housing Estate, was pulled down by the authorities.

Magira, through his legal representative, Hamza N. Dantani Esq of Kayode Ajulo & Co. Castle of Law, filed a lawsuit at the Borno State High Court, challenging the demolition.

In Alhaji M. Attom Magira v. Borno State Urban Planning and Development Board (BOSUPDB), Suit No. BOHC/MG/CV/8/2025, he sought judicial intervention to prevent what he described as an unlawful act until the court determines if he violated any urban planning regulations.

According to Dantani, the demolition was orchestrated under the directive of the current administration, led by Governor Babagana Zulum.

He condemned the act, describing it as a violation of the rule of law and an attack on private investment in the state.

“The destruction of my client’s plaza goes beyond individual loss—it signifies a blatant disregard for judicial authority and economic development in Borno State,” Dantani stated.

“This was not an enforcement of town planning laws but a politically motivated move that highlights the growing impunity within the administration.”

Dantani further argued that Magira had legally acquired the property, holding a statutory right of occupancy and obtaining all required approvals, including development permit no.

BSUPDB/DC/2194 from BOSUPDB. He emphasized that at no point during the construction phase did the authorities flag any planning violations.

The demolished shopping mall, he added, was not only a personal investment but also a significant contributor to the local economy, creating jobs and commercial opportunities.

Given Borno State’s struggles with insecurity and economic hardships, he asserted that such a development should have been encouraged rather than destroyed.

Meanwhile, the Borno State government has yet to release an official statement explaining the reason behind the demolition.

However, recent reports indicate that authorities have been clearing illegal structures and residential buildings in parts of the state capital.
