Sowore rejects police bail conditions as Falana cites precedent

Must read

Human rights activist and former presidential candidate Omoyele Sowore has criticized the bail conditions imposed on him by the Nigeria Police, describing them as unreasonable and a violation of legal principles.

Sowore, who was recently detained by the police, disclosed on his Twitter page that the Deputy Inspector General (DIG) of the Force Intelligence Department (FID), Dasuki Galandachi, had reviewed his bail conditions.

According to Sowore, the conditions now require him to produce a Level 16 civil servant as a surety and surrender his international passport—terms he has categorically rejected.

“I refuse to participate in any arrangement that undermines my personal integrity,” Sowore tweeted.

Prominent human rights lawyer and Senior Advocate of Nigeria (SAN), Femi Falana, who is representing Sowore, also addressed the matter in a letter to the DIG.

Falana referred to a 2020 Court of Appeal ruling in Dasuki v. Director-General, S.S.S., which declared such bail conditions involving civil servants as illegal.

Falana highlighted the court’s stance, emphasizing that involving public officers in bail arrangements contradicts public service rules and undermines anti-corruption efforts.

The judgment by Justice Adah (now JSC) noted that expecting a civil servant to meet such requirements is not only unreasonable but also a breach of the law.
