Alhaji Aminu Ado Bayero, the deposed Emir of Kano, has announced his intention to challenge the Appeal Court’s ruling by heading to the Supreme Court.
Bayero made this known on Sunday after rejecting the Appeal Court judgment, which had overturned a Federal High Court order that removed Muhammadu Sanusi II as the 16th Emir of Kano.
Speaking at the Nasarawa Palace of the 15th Emir of Kano, the Sarkin Dawaki Babba, Aminu Babba DanAgundi, who had filed the suit dismissed by the Appeal Court, expressed his discontent with the ruling.
He stated, “Sanusi failed to realize that he has lost in all the cases related to this matter.”
DanAgundi also criticized Sanusi for allegedly using the mosque pulpit to spread misinformation regarding the Appeal Court’s judgment.
He said, “We had initially approached the Federal High Court to challenge the repeal law by the State Assembly, which we felt was enacted haphazardly.”
He further cautioned Sanusi to stop claiming to be the Emir of Kano, stating, “Sanusi’s assertion of victory is incorrect.
The court ruled that the Federal High Court had no jurisdiction over chieftaincy matters. Our case was not about the power of the State Assembly to enact or repeal laws but about the lack of fair hearing for Bayero, who was removed without the opportunity to defend himself.”
DanAgundi stressed that the Kano State Assembly had failed to follow the proper procedures when repealing the laws that governed the Emirship.
He also called on the police and the Department of State Services (DSS) to intervene and prevent Sanusi from allegedly moving around with thugs, accusing him of attempting to disrupt peace in Kano.
“Sanusi cannot claim victory until the Supreme Court has delivered its final ruling,” he said. DanAgundi pointed out that the Appeal Court had rejected the Attorney General and Speaker of the Kano State Assembly’s efforts to prevent Bayero from claiming the Emirship, affirming that Bayero had not been given a fair hearing. “This clearly shows that Bayero remains the Emir of Kano,” he concluded.
