The chief judge of the Federal Hugh Court in Abuja, Justice John Tsoho, has turned down Justice Binta Nyako’s plea to step aside from the case involving Nnamdi Kanu, the leader of the Indigenous People of Biafra.
Kanu made the motion at his most recent court appearance.
Speaking to reporters and friends in the court, Kanu expressed his lack of trust in Justice Nyako on how his case was being handled.
The head of IPOB charged that the judge disregarded rulings from the Supreme Court.
Nyako also managed to get herself out of the situation when Kanu and his attorney made an oral request.
But the top judge stated that since 2015, two judges had already been rejected from Kanu’s terrorist case, and she returned the case file to Justice Nyako.
Tsoho added that Nyako, who has been involved in the issue for a long period, is the most qualified judge to oversee the case involving the IPOB leaders.
In addition, he said that the IPOB leader would need to submit a formal motion along with an affidavit if he insisted on recusing Justice Nyako at his subsequent appearance.
The chief judge stated that the affidavit would outline all the reasons why Justice Nyako should be recused.
Kanu’s attorney, Aloy Ejimakor, confirmed the situation and stated that his team is awaiting a court hearing notification to that effect.
