Chieftain of the All Progressives Congress (APC) in Abia State and former member of the house of representatives, Nze Chiekwe Esiaga, has withdrawn his lawsuit seeking to nullify the emergence of Donatus Nwankpa as the national welfare secretary of the APC.
This was made known in a notice of discontinuance of the suit,addressed to the Registrar of FCT high court in Apo, Abuja, and filed by counsel to the Applicant, Tony Ogbulafor.
A copy of the notice of withdrawal made available to newsmen on Friday partly read, “Take notice that the plaintiff herein desires to discontinue this suit against all the defendents and has filed this notice of Discontinuance and withdrawal wholly discontinuing and withdrawing this suit against the defendants”.
Recall that Nze Esiaga (Applicant) had in October 2023 approached Abuja Division of High Court with suit, seeking its declaration that the purported appointment of (2nd defendant) Donathus Nwankpa by the 1st defendant (Ganduje) as the National Welfare Secretary of the 3rd Defendant (APC) is contrary to the constitution of APC and the electoral Act 2022.
“An order restraining Nwankpa from performing the duties of National Welfare Secretary of the party having not been elected into that position.
“An order directing leadership of the party to constitute an electoral college to organize an election for the office of National Welfare Secretary between Hon Nze Esiaga and Chief Nduka Anyanwu who were candidates for the position of the NWS at the Convention of the Party in 2022.
“Or In The Alternative ,
reefund the claimant /Applicant the sum of #5,000,000.00, he paid to the 3rd Defendant for the nomination form and expression of interest calculated at 30% from 19/03/2022 till the determination of the suit”.
