Court remands man over alleged unlawful possession of ammunition

An Iyaganku Chief Magistrates’ Court in Ibadan, on Tuesday, ordered the remand of 35-year-old Emmanuel Gavan at Agodi Correctional Centre over alleged unlawful possession of gun and ammunition.

Gavan, of an undisclosed address, faced a two-count charge bordering on conspiracy and unlawful possession of a gun.

The trial judge, Mrs T. G. Daodu, did not obtain the defendant’s plea for lack of jurisdiction.

She said the remand was pending the issuance of legal advice on the case file from the state Directorate of Public Prosecution (DPP).

Daodu, thereafter, adjourned the matter until Sept. 3 for mention.

The prosecuting counsel, DSP Sikiru Ibrahim, had earlier told the court that the defendant allegedly conspired with others now at large to commit the offences.

Ibrahim said the defendant was arrested on May 29 at about 1.00 a.m. at Apata, Ibadan, in possession of one Barretta pistol and live ammunition with the intent to rob with them.

He said the defendant could not give a satisfactory account of why he had the items in his possession when questioned by the Police Monitoring Unit.

The prosecutor said the offences contravened Sections 3 and 6(B) of the Robbery and Firearms (Special Provision) Act, Cap R II Vol. 14 Laws of the Federal Republic of Nigeria 2004.
