Appeal Court upholds election of Ebonyi Gov, Nwifuru

The Appeal Court sitting in Lagos, on Friday, affirmed the election of the Ebonyi State, Fran­cis Nwifuru.

Nwifuru of the tuling All Progressives Congress, APC, had won the March 18, governorship poll in the state.

But his victory was challenged by the candidate of the Peoples Democratic Party, PDP, Ifeanyi Odii.

Recall that the Ebonyi State Governorship Elections Tribunal had on September 27, dismissed the PDP candidate’s petition for lacking merit.

Odii, however, sought redress in the Appeal Court seeking to set aside the tribunal’s verdict on the election.

Odii argued that the governor was at the time of the election, not qualified to contest the election on the platform of the APC because he was still a member of the People’s Democratic Party.

Ruling on the matter, on Friday, a 3-member panel presided over by Justice Jummai Sankey, dismissed the appeal the PDP candidate.

The court resolved all the five issues raised in favour of Nwifuru and dismissed the appeal for lacking in merit.

Justice Sankey in the lead judgment held that the PDP and its candidate lacked the legal right to meddle in the internal affairs of the ruling APC as it relates to the nomination of candidates.
